General Terms and Conditions of Sale
Nature Essentielle Camps, Courses and Activities
Effective from 1 August 2026
These General Terms and Conditions of Sale (hereinafter referred to as the « Terms and Conditions ») govern the contractual relationship between Nature Essentielle and any individual or legal entity booking a service offered by Nature Essentielle.
Any reservation implies full and unconditional acceptance of these Terms and Conditions, the internal regulations, the Code of Conduct and all contractual documents provided during registration.
Article 1 – Organiser
The services are organised by Nature Essentielle.
Depending on the activity concerned, they may be operated by:
- Nature Essentielle SARL;
- Nature Essentielle Montagne Association;
- any partner organisation appointed by Nature Essentielle.
Nature Essentielle reserves the right to use qualified instructors, mountain guides, activity leaders, diving professionals or external service providers whenever necessary for the proper organisation of its activities.
All instructors hold the qualifications required by the applicable regulations governing their respective activities.
Article 2 – Purpose
These Terms and Conditions apply to all services offered by Nature Essentielle, including but not limited to:
- children’s camps;
- residential camps;
- holiday programmes;
- outdoor activities;
- scuba diving;
- snorkelling;
- hiking;
- water activities;
- mountain activities;
- sports training;
- educational outings;
- private charter services;
- excursions;
- and, more generally, any activity marketed by Nature Essentielle.
These Terms and Conditions shall prevail over any other document unless otherwise agreed in writing.
Article 3 – Registration
Registration becomes final only after:
- receipt of a complete registration file;
- acceptance of these General Terms and Conditions;
- signature of all required contractual documents;
- payment of the required deposit.
Nature Essentielle reserves the right to refuse incomplete registrations or registrations that do not meet the participation requirements.
Registration is considered confirmed only upon written confirmation from Nature Essentielle.
As places are limited, registrations are accepted in the order in which complete applications and payments are received.
Article 4 – Required Documents
Participants or their legal guardians undertake to provide all requested documents before the activity begins.
Depending on the activity, these may include:
- registration form;
- medical information form;
- parental authorisations;
- image rights authorisation;
- medical certificate where required;
- PADI medical questionnaire or equivalent;
- copies of certifications or licences;
- administrative authorisations;
- any other document required for the proper organisation of the activity.
Nature Essentielle reserves the right to refuse participation where the required documents are incomplete or non-compliant.
Such refusal shall not entitle the participant to any refund except as otherwise provided in these Terms and Conditions.
Article 5 – Health Condition
The participant, or their legal guardian, declares that all medical information provided is accurate, complete and truthful.
Any illness, allergy, medical treatment, disability, contraindication or any other circumstance likely to affect the participant’s safety or that of the group must be disclosed before the activity begins.
Nature Essentielle reserves the right to request any additional medical information it considers necessary.
Participants undertake to inform Nature Essentielle immediately of any change in their medical condition before or during the activity.
Any intentional omission or false declaration that may compromise the safety of the participant, other participants or staff may result in refusal of participation or immediate exclusion without refund.
Article 6 – Mandatory Equipment
Certain activities organised by Nature Essentielle require specific equipment essential for participant safety.
Before each activity, camp or course, a mandatory equipment list is provided to participants or their legal guardians.
Participants must arrive with complete, suitable and properly maintained equipment.
If mandatory equipment is missing, unsuitable, damaged or considered unsafe, Nature Essentielle may:
- provide replacement equipment where available, subject to the applicable fees;
- adapt the participant’s programme;
- refuse access to one or more activities;
- or refuse participation in the activity if safety cannot be ensured.
Such decisions are made solely by Nature Essentielle’s staff and shall not give rise to any refund.
Legal guardians remain fully responsible for ensuring that all mandatory equipment has been provided.
Article 7 – Outdoor Activities
Nature Essentielle deliberately organises its activities in natural environments including the sea, mountains, forests, rivers, cliffs, hiking trails, mountain huts and protected natural areas.
Participants acknowledge that these environments are subject to constantly changing natural conditions, including:
- weather;
- sea state;
- wind;
- swell;
- underwater visibility;
- snow conditions;
- trail conditions;
- wildlife;
- falling rocks;
- currents;
- vegetation;
- and any other natural phenomenon.
Nature Essentielle takes every reasonable measure to ensure participant safety but cannot eliminate the normal risks inherent in outdoor activities.
Participants accept that programmes may be modified at any time whenever necessary for safety reasons.
Such modifications may concern:
- itineraries;
- schedules;
- mountain huts;
- dive sites;
- snorkelling sites;
- boats;
- activities;
- transport arrangements;
- meeting points;
- or the order in which activities are carried out.
Such adaptations shall not constitute a breach of contract and shall not entitle participants to compensation.
Article 8 – Safety
Safety is Nature Essentielle’s highest priority.
Participants undertake to comply immediately with all instructions given by instructors and staff.
Decisions made by camp directors, dive supervisors, mountain guides, instructors or any authorised member of staff in relation to safety shall take immediate effect.
Neither participants nor their legal guardians may challenge a safety decision while the activity is taking place.
Nature Essentielle reserves the right to suspend or terminate any activity whenever safety conditions are no longer considered satisfactory.
Article 9 – Participant Behaviour
Participants undertake to behave respectfully towards:
- other participants;
- staff members;
- local residents;
- other users of natural areas;
- wildlife;
- the natural environment;
- equipment provided.
Participants agree in particular to:
- comply with safety instructions;
- respect schedules;
- actively participate in activities;
- protect the environment;
- leave no litter;
- use equipment responsibly;
- respect community living rules.
The following behaviours are considered incompatible with continued participation:
- repeated refusal to follow instructions;
- deliberately endangering oneself or others;
- physical or verbal violence;
- bullying;
- discrimination;
- intentional damage to property;
- theft;
- possession or consumption of alcohol or illegal substances;
- any behaviour compromising safety or the proper running of the activity.
Nature Essentielle may issue:
- a verbal reminder;
- a formal warning;
- temporary exclusion from an activity;
- or permanent exclusion.
Such decisions are made exclusively by the management.
Where permanent exclusion is decided:
- no refund shall be made for unused services;
- legal guardians must organise the participant’s return as soon as possible;
- all costs associated with early return shall remain the responsibility of the legal guardians.
Article 10 – Responsibility of Legal Guardians
For minor participants, legal guardians remain responsible for their child until they have been formally handed over to a member of Nature Essentielle’s staff at the designated meeting point.
Responsibility returns to the legal guardians at the official end of the activity or when the child is handed back at the agreed meeting point.
Legal guardians undertake to comply with the published drop-off and pick-up times.
Significant delays may result in additional supervision charges.
Legal guardians remain legally liable for any intentional damage caused by their child to persons, equipment, vehicles, boats, mountain huts, accommodation or activity sites.
Nature Essentielle reserves the right to recover the costs of repairing or replacing damaged property.
Article 11 – Personal Belongings
Participants remain solely responsible for their personal belongings.
Unless specifically required, participants are advised not to bring:
- jewellery;
- valuables;
- large amounts of cash;
- mobile phones, tablets or gaming devices;
- fragile or unnecessary items.
Nature Essentielle accepts no liability for the loss, theft, damage or misplacement of personal belongings.
The use of mobile phones may be restricted or prohibited during certain camps in order to preserve the educational objectives, participant autonomy and group life.
Article 12 – Prices and Payment
The prices applicable are those in force on the date of booking.
All prices are expressed in euros (€), inclusive of all applicable taxes unless otherwise stated.
Activities excluding children’s camps
For all activities excluding children’s camps, a 30% deposit of the total amount is required at the time of booking.
The remaining balance is payable at the start of the activity unless otherwise agreed in writing.
Any additional services shown on the final invoice are payable on the day of the activity.
Children’s Camps
For children’s camps and holiday programmes, a 30% deposit of the total amount is required upon booking.
The remaining balance must be paid no later than one month before the start of the camp, unless otherwise agreed in writing.
Failure to pay within this period may result in the booking being considered cancelled by the customer and the cancellation conditions set out in these Terms and Conditions being applied.
Any additional services must be paid on the first day of the activity.
Article 13 – Cancellation by the Customer
Any cancellation request must be submitted in writing (by email or post).
The date on which the cancellation request is received determines the applicable cancellation charges.
Cancellation charges are as follows:
- More than 30 days before the activity: full refund of the deposit.
- Between 30 and 15 days before the activity: the deposit remains payable to Nature Essentielle.
- Less than 15 days before the activity: 70% of the total activity price is payable.
- Less than 7 days before the activity, failure to attend, voluntary withdrawal or early termination of the activity: 100% of the activity price is payable.
Any activity already started remains fully payable.
Nature Essentielle strongly recommends that participants take out cancellation insurance through the provider of their choice.
Article 14 – Cancellation or Modification by Nature Essentielle
Nature Essentielle makes every reasonable effort to ensure that its activities take place under the safest possible conditions.
However, Nature Essentielle reserves the right to modify, postpone or cancel all or part of an activity whenever participant safety, staff safety or the quality of the activity can no longer be guaranteed.
This decision may result from, among other things:
- adverse weather or sea conditions;
- natural hazards;
- administrative restrictions;
- health-related issues;
- technical incidents;
- insufficient participant numbers;
- exceptional unavailability of activity sites;
- decisions by public authorities;
- force majeure;
- or any circumstance that Nature Essentielle reasonably considers likely to compromise safety or the proper organisation of the activity.
Nature Essentielle may also modify:
- schedules;
- itineraries;
- activity sites;
- mountain huts;
- boats;
- transport arrangements;
- activities offered;
- meeting points;
- instructors;
- or the order in which activities are carried out.
Such changes shall not constitute a breach of contract.
Where Nature Essentielle cancels an activity in full, amounts actually paid shall either be refunded in full or, with the customer’s agreement, credited towards an equivalent activity.
The refund of the amounts paid shall constitute the sole compensation due.
No additional compensation may be claimed, including but not limited to travel expenses, accommodation costs, meals, loss of income, holiday costs or any other expenses incurred by the customer.
Article 15 – Insurance
Nature Essentielle is covered by Professional Public Liability Insurance for the activities it organises in accordance with the applicable regulations.
This insurance does not replace the participant’s own personal insurance.
Each participant, or their legal guardian, is encouraged to ensure that they have appropriate Personal Liability Insurance and, where appropriate, accident, assistance, repatriation and cancellation insurance suitable for the activities undertaken.
Nature Essentielle shall not be held liable for any consequences arising from inadequate or missing insurance coverage.
Article 16 – Personal Data
Personal information collected during registration is required for the administrative, educational, accounting and safety management of Nature Essentielle’s activities.
All personal data are processed in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable French legislation.
Data are retained only for as long as necessary to fulfil these purposes and comply with legal obligations.
Participants and legal guardians have the right to access, rectify, erase, restrict processing of, object to and request portability of their personal data in accordance with applicable legislation.
Requests may be submitted to Nature Essentielle by post or email.
Article 17 – Complaints and Mediation
Any complaint should be submitted in writing to Nature Essentielle as soon as possible to facilitate an amicable resolution.
If no amicable agreement is reached, the customer may refer the dispute free of charge to the competent consumer mediation service in accordance with the applicable provisions of the French Consumer Code.
The mediator’s contact details are available on Nature Essentielle’s website and may also be provided upon request.
Article 18 – Applicable Law
These General Terms and Conditions shall be governed by French law.
In the event of a dispute and failing an amicable settlement, the French courts shall have exclusive jurisdiction.
Article 19 – Image Rights
During its activities, Nature Essentielle may take photographs or videos of participants.
The use of such images is governed exclusively by the Image Rights Authorisation signed by the participant or, where applicable, their legal guardian at the time of registration.
Where no authorisation has been granted, Nature Essentielle undertakes not to use the participant’s images for communication or promotional purposes.
Images taken for safety, evidential, internal training or legal compliance purposes are not subject to this authorisation.
Article 20 – Scuba Diving Activities
Scuba diving activities are conducted in accordance with the French Sports Code, applicable French regulations and the standards of the relevant certification agencies, including PADI where applicable.
Participation is subject to the provision of all required administrative and medical documentation.
Nature Essentielle reserves the right to refuse or terminate a dive in cases including, but not limited to:
- insufficient certification or experience;
- incompatible physical condition;
- failure to provide a required medical certificate;
- unsuitable equipment;
- failure to follow safety instructions;
- dangerous behaviour;
- adverse weather or sea conditions;
- or any circumstance that may compromise safety.
The Dive Supervisor’s or Instructor’s decisions are taken solely in the interest of safety and are immediately binding.
Where a dive is cancelled or interrupted due to reasons attributable to the participant, no refund shall be due unless Nature Essentielle decides otherwise.
Article 21 – Authority of Instructors
Participants and their legal guardians acknowledge that decisions made by camp directors, dive supervisors, mountain guides, instructors, activity leaders or any person authorised by Nature Essentielle are intended solely to ensure:
- participant safety;
- staff safety;
- environmental protection;
- compliance with applicable regulations;
- the proper organisation of the activities.
These decisions are immediately binding on participants.
Legal guardians undertake to support the decisions made by Nature Essentielle’s staff and to cooperate fully whenever specific measures are taken in the interests of the participant or the group.
No challenge to a safety decision shall give rise to any claim for reimbursement, compensation or damages.
DISPUTES – CONSUMER MEDIATION
In the event of a dispute between the Customer and the company, the latter will endeavor to resolve it amicably (the Customer will send a written complaint to the professional or, where applicable, to the professional’s Customer Relations Department).
In the absence of an amicable agreement, or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer within the meaning of article L.133-4 of the French Consumer Code may, if a disagreement remains, refer the matter free of charge to the competent mediator registered on the list of mediators drawn up by the Commission d’évaluation et de contrôle de la médiation de la consommation in application of article L.615-1 of the French Consumer Code, namely :
